Property Sales - Terms & Conditions
MOORHAVEN LTD SALES & LETTINGS STANDARD TERMS & CONDITIONS
These standard terms & conditions give you, the Client, the information which we the agent, is required to give you before you enter into an agreement with us, under which we will engage in estate agency work on your behalf.
1. Details of the circumstances in which you will become liable to pay remuneration to us for carrying out estate agency works are:
SOLE SELLING RIGHTS
We do have an 8 week contract period, but are happy to work with/ alongside other agents to secure a quick sale.
2. Particulars of the manner in which Moorhaven LTD sales and lettings remuneration for carrying out estate agency work will be calculated:
C0mmission is calculated as a percentage of the sale price of the property and any fixtures included in the sale. The rate of commission is 0.9% inc VAT @ 20%
3. Particulars of payments which do not form part of Moorhaven LTD sales and lettings remuneration but which will be payable by the client to Moorhaven LTD sales and lettings and particulars of the circumstances in which such payments will become payable:
(a) Charges for specific advertising and marketing the property in accordance with a schedule agreed by you, which are due for payment by you to us on your confirmation of instructions.
(b) Charges for any advertising or marketing subsequently agreed, which are payable at the time of such subsequent agreement.
(c) Any such charges are subject to addition of VAT at the standard rate for the time being in force
4. Moorhaven LTD sales and lettings and connected persons are offering or intend to offer to any prospective purchaser or lessee of the client’s property the full range of their professional services including mortgage or other financial arrangements for the purchaser in connection with the acquisition of the client’s property, estate agency services in connection with the disposal of the purchaser’s own property, survey and valuation services, and insurance services.
Limiting Our Liability
We will only be liable to you for any los arising from our work for you if the loss is caused by our negligence or breach of contract or misinterpretation. The Partners and Employees of Moorhaven LTD sales and lettings will not be personally liable for any loss arising from our work for you.
We will not pay more than £1 million for all claims; however they arise, in connection with our work for you. We will not be liable for any losses if they arise from our reasonably relying on any information or documents supplied by you that are misleading, incomplete or not correct.
Right to cancel
You may have the right to cancel this contract under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 within 14 calendar days from the date upon which it was signed. Notice of Cancellation MUST BE IN WRITING and should be delivered or sent by post to the Moorhaven Ltd Sales & Lettings, The Pottery, Moorhaven, Ivybridge Devon PL21 0HB; or by email to email@example.com. Any Notice of Cancellation is deemed served on the day that it is delivered, posted or sent. If you have given us your written agreement to market your property within the cancellation period you may be required to pay our commission fees if we have introduced a tenant to your property prior to your serving a Notice of Cancellation.
The rules of The Royal Institution Of Chartered Surveyors and the Housing Act 2004/ Home Information Pack (No.2) Regulations 2007 oblige Moorhaven LTD sales and lettings to inform you that a copy of Moorhaven LTD sales and lettings complaints handling procedure is available on request.
